
On August 24th, The IPKat published a guest contribution by ForHum co-director Alberto Godioli (University of Groningen), focusing on ODEE v. Samherji in light of the notion of culture jamming. The blog post takes its cue from the European Court of Human Rights’ recent decision to declare ODEE’s application inadmissible — which, Alberto argues, is a major missed opportunity to reflect on the balancing of freedom of expression and IP rights, especially in cases involving parody and some degree of temporary (strategic) confusion.
