Summary
Adam Broad was employed as a Trainee Estate Agent by the respondent before being dismissed for gross misconduct. After a ransomware attack on the company, the IT consultant was called in to clean and re-install security software. He noticed that the claimant’s computer had no malware protection and there was installed a gambling software called Betfair. When he called to check this with Mr Broad, the claimant told him not to worry about it and said ‘I do it all the time, if you keep quiet I’ll give you half’. A colleague who overheard him thought he was joking but the consultant had taken him seriously. The consultant contacted Mr Craig (the respondent’s husband) informing him that the claimant’s log in details had been used to install betting websites and he had offered him a bribe. Mr Craigs understood from this that the Claimant was responsible for the activity, when he was questioned about it he said that he had not done it. Following an investigation he was dismissed for gross misconduct.
The unanimous decision of the tribunal is that the claimant was unfairly dismissed by the respondent. The respondent shall pay the claimant £10,017.35.
